Instant Triple Talaq Illegal

The draft was prepared by the Home Minister Rajnath Singh who is also an inter-minister group head. This draft law aims to curb the practice which continues despite the Apex Court striking it down.
‘Muslim Women Protection of Rights on Marriage Bill’ was sent to the state governments on Friday to gather their views. The governments are asked to respond to the draft urgently, said a senior government functionary
While the draft states, that giving instant triple talaq will be illegal and null and void and will attract a jail term up to 3 years for the husband. The members of the group apart from Rajnath Singh included External Affairs Minister Sushma Swaraj, Finance Minister Arun Jaitley, Law Minister Ravi Shankar Prasad and his junior in the Ministry Mr. PP Chaudhary.
Under the draft law, triple talaq in any of the forms, like speaking, in writing or by an electronic medium such as SMS, WhatsApp and Email would be wrong or illegal and void.
Women can seek custody of her minor kids from the magistrate who will have the final decision. The proposed law would be applicable, on instant triple talaq and it would give power to the victim to approach a magistrate seeking subsistence allowance for herself and her minor children.
In winter Parliamentary sessions they are planning to raise the issue. Overall this looks like a boon to deprived Muslim women.
