Supreme Court Rejects PIL Requesting Independent Audit of EVM Source Code:

The Supreme Court declined to consider a PIL that called for an examination of the software utilized in the Election Commission’s electronic voting machines (EVMs).

A bench led by Chief Justice D Y Chandrachud, along with Justices J B Pardiwala and Manoj Misra, asserted that there was no substantial evidence to suggest that the Election Commission had violated its constitutional obligations in conducting elections.

The court pointed out that the Election Commission holds authority over elections and emphasized the absence of any information casting doubt on the electronic voting machines. Prior to filing the petition, Sunil Ahya, the PIL petitioner, had made requests to the Election Commission for an independent review of the electronic voting machines’ source code, emphasizing the critical role of the source code in safeguarding democracy.
