UK watchdog fines Facebook $70 mn over enforcement order breach

0

As Facebook gets prepared to rebrand itself for the ‘Metaverse’ future, the UK anti-trust regulator on Wednesday fined the social network nearly $70 million for deliberately withholding information related to ongoing antitrust probe of its acquisition of popular GIF search engine Giphy.

The Competition and Markets Authority (CMA) also fined Facebook 500,000 pounds for changing its Chief Compliance Officer on two separate occasions without seeking consent first.

This is the first time a company has been found by the CMA to have breached an initial enforcement order (IEO) by consciously refusing to report all the required information.

“Given the multiple warnings it gave Facebook, the CMA considers that Facebook’s failure to comply was deliberate. As a result, the CMA has issued a fine of 50 million pounds for this major breach, which fundamentally undermined its ability to prevent, monitor and put right any issues,” the watchdog said in a statement.

It is standard practice to issue an IEO at the start of an investigation into a completed acquisition. This ensures that companies continue to compete with each other as they would have without the merger, and prevents the companies involved from integrating further while a merger investigation is ongoing.

The CMA imposed this type of order on Facebook in June 2020 in relation to its purchase of Giphy.

Facebook said last year that it was acquiring Giphy for nearly $400 million.

The social network was also criticised last year by the Competition Appeal Tribunal and Court of Appeal for its lack of cooperation with the CMA and “what might be regarded as a high-risk strategy” in relation to not complying with the IEO and not keeping the CMA updated as the IEO required.

“Companies are not required to seek CMA approval before they complete an acquisition but, if they decide to go ahead with a merger, we can stop the companies from integrating further if we think consumers might be affected and an investigation is needed,” said Joel Bamford, Senior Director of Mergers at the CMA.

“We warned Facebook that its refusal to provide us with important information was a breach of the order but, even after losing its appeal in two separate courts, Facebook continued to disregard its legal obligations,” he said, adding that this should serve as a warning to any company that thinks it is above the law.

The CMA’s investigation into Facebook’s merger with Giphy is ongoing.

The authority has provisionally found that Facebook’s takeover of Giphy will negatively impact competition between social media platforms.

Cricket Australia rejects England’s request to move Ashes opener to Sydney: Reports

The England and Wales Cricket Board’s (ECB) request to Cricket Australia (CA) to shift the opening Ashes Test from Brisbane to Sydney has been rejected on the ground that it “could lead to added complications” that could jeopardise the series.

The Joe Root-led England side are scheduled to travel to Australia next month for the five-Test Ashes series beginning December 8 at The Gabba in Brisbane. The ECB had requested CA to move the opener to Sydney, which would have enabled England cricketers avoid Queensland’s 14-days mandatory quarantine.

Sydney, which is in New South Wales, “will become the first Australian state to permit fully vaccinated travellers from next month with no quarantine for those testing negative for Covid-19, leading the ECB to explore the possibility of starting in Sydney — a proposal that had the enthusiastic backing of the players,” dailymail.co.uk said in a report on Wednesday.

“During talks with Cricket Australia however, it was concluded that the change could lead to added complications with fears over the tourists getting stuck in New South Wales due to other states’ strict border controls without having undergone quarantine — a prospect that could derail the entire tour,” the reports added.

With the ECB proposal being stonewalled, the Ashes will begin as scheduled at The Gabba in Brisbane on December 8. The cricketing circus will then move to Adelaide then Melbourne and Sydney.

Though the fifth and final Test is scheduled at Perth, strict 14-day quarantine protocols in Western Australia could force CA to move the match to Sydney, which could mean back-to-back Tests at the SCG.

Instagram will let you create posts from desktop

0

After testing the ability to post feeds from desktop browser, Facebook-owned Instagram will now let users create posts from its web platform.

The social network is issuing updates that will culminate on October 21, when users worldwide will have the option of posting photos and short videos (under one minute) from their computer browser, reports Engadget.

That’s helpful if you would rather not reach for your phone, of course, but it could be particularly useful for businesses and enthusiasts that want to make better use of their expensive cameras.

There are plenty of updates for mobile users, too, the report said.

A ‘Collabs’ test feature now available lets two people co-author posts and Reels. Users just have to invite someone else from the tagging screen to get them involved.

Followers for both users will see the post, and it will even share views, likes and comments. It is safe to say this could be valuable for everything from superstar team-ups to sponsored posts, as per the report.

Another test will let users start nonprofit fundraisers right from the new post button, simplifying charity efforts.

Everyone will see new music-driven Reels effects on October 21, including Superbeat (special effects in sync with the beat) and Dynamic Lyrics (3D lyrics that flow with the track). They are not as flashy as the other additions, but may help you focus on sharing content rather than editing it.

Sanya Malhotra talks about sex still being a taboo subject in India

Actress Sanya Malhotra agrees that sex is still a taboo subject in India however she feels with the help of cinema and other platforms things are changing.

Sanya features in the show ‘Sasural Wonder Phool’ on Audible. It also stars Varun Sharma. The show is a romantic comedy, where Sanya’s character ‘Ashima’ gets married to a sex therapist played by Varun, who runs a sex clinic with his entire family.

Talking about the subject of sex, Sanya told IANS: “Definitely a taboo. But with films, with cinema, with other platforms I think things are changing, and according to me, I think, I believe that there is a demand for such stories that’s the reason the creators are willing to create shows like ‘Sasural Wonder Phool’.”

She added: “I’m hoping with this show and we are able to change a few things maybe inspire people to be more comfortable when they’re talking about sex or sex-related issues. I honestly feel that my character in ‘Sasural Wonder Phool’, which is Ashima, reflects our society wonderfully, you know she’s a prude, she’s not so comfortable talking about sex.”

“And when she gets to know that her in-laws and her husband run a sex clinic, it’s a complete shocker for her.”

The ‘Dangal’ actress hopes that the audiences connect with her character’s journey.

Sanya said: “But then, obviously, it’s also a learning experience for her that it’s so natural, it’s so natural to talk about it too. So I hope that the audience connects to her and her journey from not being so comfortable talking about sex to maybe okay, or…whether she’s the same, whether she changes or not.”

This is the first time Sanya has tried her hands in audio storytelling.

Asked what motivates her to explore different platforms, she said: “I love performing! No matter what the platform or the medium is.”

She revealed that the show ‘Sasural Wonder Phool’ was recorded last year during the pandemic and that time she was really “missing, acting and being on set and performing.”

“So, when I got the offer and when I got to know that it’s with Varun Sharma, I could not say no to it. I really admire Varun too for his acting skills and his comedy timing and it was very exciting to know that I will be working with him on this one. So definitely an experiment, but I’m so glad that I did it. It was a great learning experience because it’s very similar to acting.”

Vishnu Manchu clears the air on his presence at Pawan Kalyan rally

Vishnu Manchu, who shared the dais with Telugu ‘power star’ Pawan Kalyan at the ‘Alai Balai’ event here, had tweeted a video which had drawn criticism from both sides following the recent MAA elections.

Most of the replies to the tweet had criticised that Vishnu was ignored by Pawan Kalyan at the event. Some netizens even went further and commented that Vishnu deserved to be ignored for the unwanted comments he made on the ‘Mega’ family during the MAA elections.

Vishnu Manchu finally came out in his defence, clearing the air about the video. Vishnu said, “I shared the video to surprise Pawan Kalyan’s fans, as Pawan Kalyan has a lot of fans. It is not true that he ignored me or we have any kind of enmity as it is projected. As per the protocol at the Alai Balai event, we did not talk on the stage. But sure had a brief chat off the stage,” Vishnu said.

Vishnu added that Pawan Kalyan had wished him on winning the MAA elections. “Pawan Kalyan expressed that MAA is like his mother, and asked me to protect it with full responsibility”. Going forward, Vishnu also posted a YouTube link, where Pawan Kalyan and Vishnu seem to be having a brief conversation.

Well, the industry folks are wondering why Vishnu is keen to prove these things, while he has a greater responsibility as the president of MAA.

The recent Movie Artistes Association (MAA) elections had triggered friction among Tollywood artistes. With the elected president Vishnu’s media interactions, and his father Mohan Babu’s public statements, things got only worse.

Vishnu Manchu had commented about Chiranjeevi and his family being against him during the elections.
