Indefinite adjournment in pre-arrest bail matter detrimental to rights: SC

The Supreme Court has observed that indefinite adjournment in a matter relating to anticipatory bail, that too after admitting it, is detrimental to the “valuable right” of a person.

A bench headed by Chief Justice N.V. Ramana and comprising Justices A.S. Bopanna and Hima Kohli said: “When an application for anticipatory bail was listed before the learned Single Judge, which was also accompanied by an application for ad-interim relief, the learned Judge should have decided the same one way or the other, so far as the ad-interim prayer or should have taken up for consideration after giving some reasonable time to the state.”

It added that even if admitted, the judge should have listed the same for final disposal on a specific date, keeping in view the nature of the relief sought in the matter.

“Not giving any specific date, particularly in a matter relating to anticipatory bail, is not a procedure which can be countenanced. We are of the considered view that this type of indefinite adjournment in a matter relating to anticipatory bail, that too after admitting it, is detrimental to the valuable right of a person,” it held.

The top court, however, made it clear it is not going into the merits of the matter.

“When a person is before the court and that too in a matter involving personal liberty, least what is expected is for such a person to be given the result one way or the other, based on the merit of his case and not push him to a position of uncertainty or be condemned without being heard when it matters,” it said.

The top court’s February 21 order came on a plea filed by Rajesh Seth citing delay by Chhattisgarh High Court in deciding his pre-arrest bail plea.

The petitioner was aggrieved that the high court merely admitted the anticipatory bail application filed by him with a further direction to list in due course, but did not consider his application seeking interim protection during the pendency of the bail application. Seth said the co-accused in the same FIR has been granted interim protection from arrest till the final disposal of application for anticipatory bail by the high court.

The top court asked the single judge of the high court to dispose of the anticipatory bail application, pending adjudication before him, on its own merits and in accordance with the law, expeditiously and preferably within a period of two weeks.

“If the main application cannot be disposed of for any reason, the I.A. for interim relief be considered on its own merits. Till such time, we grant interim protection from arrest to the petitioner herein. We clarify that this shall however not influence the view to be taken by the Learned Single Judge on merits,” it said.

KCR vows to put India on right track

Telangana Chief Minister K. Chandrasekhar Rao on Wednesday vowed to put the country on the right track and said he was even ready to sacrifice his life for the purpose.

The Chief Minister, who is leading the efforts to cobble together an anti-BJP alliance, reiterated his national ambitions while inaugurating Mallanna Sagar, India’s largest man-made reservoir, in the state’s Siddipet district.

“Come what may, to put the country on the right track, if need be, I will sacrifice my last drop of blood. I will set right the country and will march forward,” he told a public meeting.

The Telangana Rashtra Samithi (TRS) chief voiced concern over the country losing its way and remarked that an “evil system” is prevailing. “Disgusting things are happening. Havoc is being created in the name of religion and caste,” he said and cited the current situation in neighboring Karnataka.

KCR, as Rao is popularly known, said some people including IAS officers shared with him how their children studying in Bengaluru were scared to go to schools and colleges due to the situation created there in the name of religion.

The TRS chief said that the image of Bangalore known as Silicon Valley of India took a beating due to the “hate” being spread at educational institutions. Pointing out that Hyderabad is next only to Bengaluru in terms of IT exports and was attracting huge investments, he cautioned people against the path being followed by the neighboring state.

KCR termed communalism cancer and called for rooting it out. “This evil posed a threat to the country. We should not allow this cancer to spread. We should throw it out of the country,” he said.

He said all states and regions of the country can develop and prosper if the government at the Centre is virtuous and does not divide people in the name of religion and caste. He said nobody would come to invest in a state or a country where there is communal strife and there is no peace and law and order.

He told people that since they were in public life and were determined to do good to people, they can’t be mute spectators to what was happening in the country.

“I am going ahead to impact national politics. For this, I will utilize all the strength God has given me and will use all my intellect,” he said.

KCR said despite no support from the Centre, Telangana made rapid strides in all sectors during the last seven years and has emerged as the role model for the entire country.

He listed out the schemes implemented by his government to ensure 24-hour electricity supply to all sectors, drinking water to every household, welfare of farmers, and all other sections of people.

Delhi Deputy CM Sisodia gets PWD portfolio too

Delhi Deputy Chief Minister Manish Sisodia has been allocated the Public Works Department, which was being held by Health Minister Satyendra Jain, an official notification said on Wednesday.

“On the advice of the Chief Minister, Lt Governor Anil Baijal has given the responsibility of Public Works Department to Manish Sisodia. This new responsibility will be in addition to the portfolios he is already holding,” read the notification issued by the Delhi government.

Sisodia is already handling 10 important departments which include Education, Finance, Planning, Tourism, Art and Culture, and Employment among others. With the new responsibility, he will be holding charge of a total of 11 departments.

Last year in October also, Sisodia was given the additional responsibility of the Labour Department which was being held by Gopal Rai.

Delhi can have a total of seven ministers currently which also includes the Chief Minister. However, Chief Minister Arvind Kejriwal doesn’t hold any portfolio in this government.

Jain, who had charge of eight departments so far, now holds seven – Health, Industries, Power, Home, Urban Development, Irrigation, Flood Control, and Water Department.

While Rai has three departments and Imran Hussain two, Rajendra Pal Gautam and Kailash Gahlot have five departments each.

India look to avoid clean sweep by New Zealand ahead of World Cup

India will be looking to avoid a 5-0 clean sweep when they face New Zealand in the fifth and final ODI at the John Davies Oval on Thursday.

The match will be India’s last game in the format before they jump into the warm-up and main competition of the Women’s Cricket World Cup. The batting and bowling haven’t clicked together for India in all four losses, leaving them with more worry points than solutions.

Bowling, in particular, is a huge worry if one goes by Mithali Raj’s words after losing a truncated fourth ODI by 63 runs. “But to be honest the bowling is a bit of concern before the World Cup. We want all our main bowlers to get their rhythm. We are adapting to the conditions but there are spells where the bowlers have bowled well but we are not consistent and it is something that we are looking to improve.”

The spinners, barring Deepti Sharma, have been far from convincing. The pace attack also needs to shrug off inconsistency. Apart from the unit failing to click in unison, they have also been overpowered by the all-around brilliance of Amelia Kerr. But the positive aspect for India has been the form of wicketkeeper-batter Richa Ghosh and Mithali showing some glimpses of consistency.

New Zealand, on the other hand, will be delighted with how the series and their experimentations have turned out. Their top batters, Amelia alongside Suzie Bates and captain Sophie Devine, have been impressive. The lower-order, featuring Lauren Down and Katey Martin, have proved that they can finish matches when the top-order may not step up to the occasion.

Apart from Amelia’s six wickets, her sister Jess Kerr has been great with seven wickets. She has been well supported by Hayley Jensen (five wickets) and skipper Sophie (four wickets) in ticking all the right boxes. India will be hoping that the unit clicks together to get their first win in the country and snap the winless streak.

Vice President M. Venkaiah Naidu on Wednesday cautioned that with the flattening of the Covid pandemic curve, people should not lower their guard and should continue with the practice of washing hands frequently.

Virtually addressing the national ‘WASH Conclave-2022’, the Vice President said that children should grow up in an environment that is healthy – physically and emotionally.

“Preventive healthcare measures such as safe water, sanitation, and hygienic practices begin from anganwadis and primary schools,” he said. He underlined the importance of basic amenities like safe drinking water and sanitation in preventing diseases and contributing towards the overall well-being of people and Naidu cautioned that with the flattening of the Covid pandemic curve, people should not lower their guard and should continue with the practice of washing hands frequently.

Observing that taking forward the WASH agenda to Gram Panchayats is critical, Naidu stressed the need to ensure institutional strengthening of the Panchayats for effective service delivery to the last mile.

“This is a key aspect of governance which I always emphasize –efficient last-mile delivery of services in every field — holds the key to fast-tracking all-around development,” he said.

The Vice President noted that as a nation, we need to ensure that every household gets all the basic facilities – the most essential of them being WASH-related and this can be realized only if a vast array of players join hands with singular focus and determination.

The Vice President observed that in many Indian languages the word water is associated with ‘jeevan, which means life’.

Quoting the oft-repeated sentence ‘Jal hi Jeevan hai’, Naidu said, “Our forefathers saw the underlying truth behind this statement centuries ago — we have, therefore, for millennia, worshipped life-giving rivers across the length and breadth of this vast country.”

Calling the adequate amount of safe drinking water for every rural household as a basic necessity, Naidu said that India is making considerable progress in this regard.

He called for further fast-tracking and bestowing greater attention to all aspects relating to WASH facilities in both rural and urban areas.

The three-day virtual conclave on Water, Sanitation, and Hygiene (WASH) is being organized by the National Institute of Rural Development and Panchayati Raj (NIRDPR), Hyderabad in association with the Ministry of Jal Shakti, Ministry of Panchayati Raj, UNICEF, and other development partners.

Haryana launches prog to attract investment of Rs 25,000 cr

Haryana Chief Minister Manohar Lal Khattar on Wednesday launched a five-year program named Programme to Accelerate Development for MSME Advancement (PADMA) that is expected to bring in investment of over Rs 25,000 crore.

PADMA is a multi-departmental and multi-agency program that would not only promote the local products but would also give ample employment opportunities to the local youth, especially to the targeted Antyodaya families.

“Based on the principles of local yet global, PADMA aims to create a dynamic, self-sustainable and thriving industrial infrastructure at the cluster level for each block of Haryana,” said the Chief Minister while formally launching PADMA at a function here.

Deputy Chief Minister Dushyant Chautala and Minister of State for Labour and Employment Anoop Dhanak were present, among others.

“PADMA, a five-year program, will not only revolutionise the industrial landscape in Haryana through the development of PADMA industrial parks across all the blocks but is also expected to bring in investment of over Rs 25,000 crore in the form of infrastructure, common facility centers, business development service centers, and set-up new industrial units in each block,” said Khattar.

He said around 10,000-15,000 new units are expected to be opened by next year in these clusters.

The Chief Minister said in line with Atmanirbhar Bharat and to support state Micro, Small, and Medium Enterprises (MSMEs), a tremendous focus has been on the development of its MSME ecosystem. “With this in mind, the Haryana government has set up a separate directorate for the MSMEs.”

“The MSMEs play a significant role in the economic landscape of Haryana, contributing over 22 percent to the Gross State Value Added (GSVA),” said the Chief Minister.

He said under PADMA, one product in each block of 22 districts, has been identified based on the locally available resources, existing micro-enterprise ecosystem, demographic profile, key opportunities, sunrise sectors, and growth potential.

“If required necessary training and skilling would also be given so as to promote this sector,” he added.

Deputy Chief Minister Chautala said with the launch of PADMA a new benchmark has been set for taking the industries forward.

“One year ago, the blueprint of this One Block One Product was prepared and a survey and study were conducted before the implementation of this program. The findings highlighted that there are various local products at block levels that have huge market potential. In a bid to give a boost to each block and their special product on a larger level, PADMA program has been launched,” Chautala, who also holds the portfolio of Industries and Commerce Departments, said.

Google Chat to replace classic Hangouts for Workspace users from March

Google has announced that it is now ready to move into the final phase of the migration from Classic Hangouts to Google Chat for Google Workspace customers.

The company said it will turn on the “Chat preferred” setting for any customers who have not already done so, making Google Chat the default chat application beginning March 22.

“This means that when users visit classic Hangouts in Gmail on the web or the classic Hangouts mobile apps, they will be directed to Chat,” the company said in a blogpost.

“Hangouts.google.com will continue to work. It is not possible to opt-out of this change. If you would like to export your classic Hangouts and Chat data, learn about exporting your organization’s data,” it added.

After domains are upgraded to “Chat preferred”, all classic Hangouts applications, except hangouts.google.com, will be disabled. Additionally, the “Chat and classic Hangouts” and “Classic Hangouts only” settings will be removed from the Admin console.

Messages sent in classic Hangouts will continue to be retained and held according to policies set for Chat, and searchable and exportable with Gmail search in Vault. Messages sent in Chat are subject to retention rules and hold you set for Chat and searchable and exportable with Chat search in Vault.

The company also mentioned that except for a few special cases, all the conversation history from Hangouts will be available in Google Chat. However, starting mid-March 2022, any newly created spaces in Google Chat within a domain will not appear in classic Hangouts.

Apple says employees, customers safe after store hostage situation

After a 27-year-old man held an Apple Store customer hostage for several hours at the company’s flagship store in Amsterdam and demanded $200 million in cryptocurrency, the tech giant has said that all its employees and customers are safe.

The suspect, in camouflage gear, fired a gun and then held an Apple customer hostage for several hours before being apprehended late on Tuesday.

“We want to thank local law enforcement for their exceptional work and ongoing investigation. Our teams and customers took swift action and showed incredible strength and resolve,” an Apple spokesperson told TechCrunch on Wednesday.

Several other people who were also inside the Apple Store managed to escape.

“The suspect has since been taken to hospital. For the time being, we are still conducting extensive research in the Apple Store on Leidseplein,” the Amsterdam Police said in a tweet.

Police on the scene hit the running suspect with an armored BMW X5.

“As the suspect lay motionless on the ground, police sent over a robot to check him for explosives, confirming none were present,” reports The Verge.

It’s unclear what prompted the incident. According to the police, the suspect “sent selfies and other photos to AT5 (a local publication) during the incident that appeared to show him wearing a bomb vest”.

1st T20I: India aim to continue winning juggernaut against Sri Lanka

India is yet to be beaten in T20Is in the new full-time captaincy era under Rohit Sharma. The hosts’, after wrapping a 3-0 win over West Indies in Kolkata, will be aiming to continue the winning juggernaut against Sri Lanka in the first T20I at Bharat Ratna Shri Atal Bihari Vajpayee Ekana Cricket Stadium on Thursday.

The series against Sri Lanka offers the chance to players like Sanju Samson, Ruturaj Gaikwad, Shreyas Iyer, Ishan Kishan, and Avesh Khan to present their skillsets ahead of the Men’s T20 World Cup in Australia later in the year.

Though Rishabh Pant, Virat Kohli, Suryakumar Yadav, Deepak Chahar, and Shardul Thakur are unavailable, India will be hoping that the return of Jasprit Bumrah and Ravindra Jadeja will boost the experience in the hosts’ camp.

In the absence of Hasaranga and Theekshana, Sri Lanka might employ left-arm spinner Praveen Jayawickrama and leg-spinner Jefferey Vandersay to make the most out of the spin problem of the Indian batters. The pace department looks good with Dushmantha Chameera, Lahiru Kumara, and Chamika Karunaratne.

What the Indian bowlers will be trying to exploit to the fullest will be the top-order struggles of Sri Lanka. Against Australia, Sri Lanka lost 4-1 and one of the big reasons for the losses was down to the top-order failing to fire. The top-order unable to go big in the start of the innings meant that Sri Lanka was unable to chase down or post a big total.

The only solace for Sri Lanka’s misfiring batting came in the last match when Kusal Mendis made an unbeaten 69 and was well-supported by Shanaka for a consolation five-wicket win. Top-order batting is something that Shanaka had mentioned about in the pre-series virtual press conference.

“Especially in our batting side. India got a very strong bowling line-up. So, I am looking forward to our batters in the top to get some fire. Whenever our top order gets among the runs, we got a better chance of winning as the bowlers get a chance to defend. So, looking forward to that in the series.”

Overall, the series promises to be a clash between a team on a winning run and a side trying to discover their batting potential.

‘RRR’ makers all set for second phase of promotions

The second phase of promotions for S.S. Rajamouli’s much-awaited magnum opus ‘RRR’ will kick off soon.

As per reports, the producers of ‘RRR’ have made plans to resume the promotions, as the release date of the Ram Charan and Jr NTR-starrer is approaching on March 25.

Apparently, Rajamouli and his team, along with actors Ram Charan, Jr NTR, and Alia Bhatt will start promoting the movie from March 1. A big event is being planned in Dubai for the same.

Apart from the events, the team will be interacting with the media and the public during their visits to important cities.

Ram Charan, Jr NTR, Alia Bhatt, and Rajamouli had earlier promoted the film big time in December 2021 and January hoping that the film would release on January 7, as planned.

As a result of the third wave of Covid along with the shutting down of theatres in states such as Maharashtra and Delhi, along with night curfews, and other adversaries, the film was postponed.

Now that ‘RRR’ will hit the screens on March 25, the team will promote the movie yet again.

‘Reduce GST as beedis exported to Europe, Gulf and US’

Indian beedis are being exported to various countries, said officials at a panel discussion and therefore on the need to reduce the Goods and Services Tax (GST) tax rate on the product from 28 percent.

Industry officials said beedis are exported from India to the Gulf Countries, Singapore, West Indies, the Netherlands, France, and even to the US.

However, the panelists from different walks of life pressed for a reduction in the GST rate.

According to them, the 28 percent tax rate has resulted in beedi production moving from organized to unorganized segment affecting the women workers and other marginalized sections as they are deprived of benefits like contribution to Provident Fund, paid leave, bonus, gratuity, insurance, and others.

Speaking at a panel discussion Dr. Ashwani Mahajan, National Convener, Swadeshi Jagran Manch said: “High GST on beedis is detrimental to both the industry and the workforce. The production of beedis in India provides employment to nearly 90 lakh to one crore people. A majority of the workers are women who live in Maoist dominated areas where no alternative job opportunities exist.”

He said it is critical to reduce the tax on beedi or else the industry will face the risk of cheap cigarette imports from China.

According to Arjun Khanna, Joint Secretary, All India Beedi Industry Federation, the industry has been playing a big role in generating revenue and employment in some of the remotest regions of India and a high tax rate will result in unemployment and socio-economic ramifications.

Panelists said the high tax rate will result in tax evasion and capture of branded beedi market by cheap unorganized players.

“Beedi is an indigenous man-made product which has become the primary source of income for well over 20 lakh families in Bengal. The shutting down of the beedi industry will result in a severe impact on the livelihood of these families as no other alternatives have been provided to these families by the Central Government,” Khallilur Rahaman, Member of Parliament, TMC said.

India captain Rohit Sharma on Wednesday wished for a quick recovery of injured batter Suryakumar Yadav. A couple of hours before Sharma’s virtual press conference ahead of the T20I series against Sri Lanka starting from Thursday, Yadav along with pacer Deepak Chahar was ruled out of the series due to a hairline fracture on hand and a right quadriceps injury, respectively.

“Surya’s injury is obviously a setback. He was in great form as we saw in the last series and he was the man of the series. But there are so many guys waiting for an opportunity and more than happy for them to come and fill in. At the same time, I am a little sad for Surya because he was in such great form and wanted to carry on his great form further,” said Sharma.

In the recent T20I series against the West Indies, Yadav had scores of 34 not out, 8 and 65 to be the highest run-getter in the three matches and propel India in winning the series 3-0.

In the ODI series against the same opposition with the same scoreline, Yadav had scores of 34 not out, 64, and 6. Also, Yadav has jumped 35 spots to No.21 in the latest ICC Men’s T20I Player Rankings.

“But injuries, you can’t really help. A freak injury, he was standing in the slips, got hit on his thumb and you can’t control these things. It happens but I wish him a quick recovery and he comes back soon. But a lot of guys are there on the team, waiting for the opportunity. I will be really happy for them to come in and get the job done for the team,” added Sharma.

Yadav and Chahar will now head to the National Cricket Academy (NCA) in Bengaluru for further management of their injuries.

Tsitsipas captures 200th win, advances in Acapulco tennis

Greek tennis player Stefanos Tsitsipas earned his 200th tour-level victory at the Mexican Open, overcoming Serbian Laslo Djere 7-6(7), 7-6(4) to reach the second round here on Wednesday (IST).

In a tough clash at the ATP 500 event, the Greek ranked No.4 in the world, saved two set points in the opening set at 5-4 on Djere’s serve and then at 6/7 in the tie-break, before he edged a tight second set to advance in a match lasting two hours and 15 minutes.

“It was very challenging,” Tsitsipas was quoted as saying by atptour.com. “There were a lot of tight moments today. It was not easy coming in and trying to adjust, but I felt much more comfortable game after game. There was a point where I was getting ahead and playing my best tennis. He put up a great fight and he wasn’t easy to crack. But those two tie-breaks I managed really well and managed to execute my game plan.”

The Greek had claimed his maiden tour-level win in October 2017, beating Karen Khachanov of Russia in Shanghai in straight sets, according to atptour.com. Since then, the 23-year-old Tsitsipas has captured seven tour-level titles, including the 2019 Nitto ATP Finals trophy in Turin and the 2021 Rolex Monte-Carlo Masters crown.

TikTok rival Dubsmash dies quietly

Popular online discussion platform Reddit, which acquired short-form video social platform Dubsmash late last year, has finally shut down the platform.

Dubsmash will not be available to download through the App Store or Google Play. Also, downloaded apps will stop functioning on the same date.

“The Dubsmash team has been accelerating Reddit’s video, so parts of Reddit will feel familiar to Dubsmashers,” the company said in the blogpost recently.

“Dubsmashers can continue connecting with each other at r/dubsmash and hop over to Reddit to discover an endless stream of new creators and communities that match their many interests and talents,” it added.

When Reddit acquired Dubsmash, the app was drawing more than 1 billion video views per month.

About 25 percent of all Black teens in the US were on Dubsmash, and females represent 70 percent of users. About 30 percent of users used to log in every day to create video content, indicating a high level of retention and engagement.

Last year, the company said it will integrate Dubsmash’s innovative video creation tools into Reddit, which will empower Reddit’s own creators to express themselves in original and authentic ways.

‘Creating confusion’, SC junks plea against physical exams for Class 10, 12

The Supreme Court on Wednesday junked a plea seeking cancellation of physical exams for Class 10 and 12 scheduled to be conducted by all state boards, CBSE, ICSE, and NIOS.

The top court pulled up petitioners for filing premature petitions and creating confusion among lakhs of students through such PILs. It warned the petitioner of exemplary costs if such action is repeated.

A bench headed by Justice A.M. Khanwilkar told the petitioner’s counsel, “Creating confusion by such petitions, what kind of petition you filed?”

Advocate Prashant Padmanabhan, representing the petitioners, urged the top court to see the present CBSE directions and also pointed at the petition filed in connection with the exams last year. The bench, also comprising Justices Dinesh Maheshwari and C.T. Ravikumar, said what has happened in past cannot become a norm, and that will be misleading. Padmanabhan added that CBSE has conducted the first term exam in offline mode in December 2021 in MCQ mode and results aren’t published yet.

Justice Khanwilkar said the situation has not arrived yet and told the council to allow authorities to take a decision in the matter. “How can you pre-empt everything”, said the bench.

The top court added, “These kinds of petitions are misleading, what kind of publicity do these petitions get. These petitions create confusion. Let students and authorities do their jobs.”

The plea said many students studying in CBSE, ICSE, NIOS, and state board approached the petitioner, Anubha Shrivastava Sahai, for issues they are facing regarding the board exams and are directly affected by the outcome of this PIL.

“The other petitioners are students as well as the parents from different states, who were aggrieved by the Board’s decision. That, the mental pressure that is created for performance in this exam is so much that every year a number of students commit suicide for fear of underperformance, or of failure”, said the plea.

The plea added, “To make students appear and face the examination with the additional fear of getting infected by the Covid-19 virus will not only be unfair but the same will be absolutely inhuman”.

The plea urged the top court to issue directions to concerned authorities to pass a notification regarding alternate mode of assessment of students from Class 10, 11, and 12 of CBSE, ICSE, NIOS, and state boards instead of offline exams.

The second petitioner in the plea is the Student Union of Odisha. The plea has also included a list of students from various parts of the country who approached Sahai regarding issues with the board exams.
