SC sets aside SAT’s order in Marsh India vs Atkins Special Risks

0

The Supreme Court has set aside the Securities Appellate Tribunal’s (SAT) order against the Indian insurance regulator and Marsh India Insurance Brokers Private Ltd and restored the sector regulator’s order dated January 9, 2018.

The apex court, in its order, said it could not find any documentary evidence on which the SAT had come to the conclusion that the reinsurance business of Jagson International Ltd was obtained by Marsh India by illegal means as alleged by its rival, the London-based reinsurance broker Atkins Special Risks Ltd.

The Marsh India Insurance Brokers had approached the Supreme Court against the SAT’s order. The apex court’s recent order is the final setback for SAT in the case.

Earlier the Supreme Court had expunged the SAT’s remarks against the former Member (Non-Life), Insurance Regulatory and Development Authority of India (IRDAI) P.J. Joseph as `uncalled for and deserve to be set aside” on an appeal by the IRDAI.

The SAT, on March 16, 2018, setting aside an IRDAI order, had said: “We fail to understand as to how Member (non-life) could make a such false statement in the impugned order. In our opinion, the impugned order passed by P.J. Joseph (non-life) virtually amounts to aiding and abetting corruption in the insurance business by the regulator which cannot be tolerated.”

It had directed the insurance regulator to entrust the matter to a competent officer other than Joseph for fresh orders on Atkins’ complaint on merits.

The basic case is about Marsh India Insurance Brokers getting the reinsurance business of Jagson International – having interests in oil exploration and aviation – which was earlier handled by Atkins Special Risks.

The Atkins Special Risks had complained to IRDAI stating that between 2002-2012, it provided international reinsurance cover to Jagson International. From 2010 onwards Jagson International’s Chairman Jagdish Pershad Gupta started demanding, through email, a cut in Atkins Special Risks’ reinsurance commission.

In 2012, Jagson International’s reinsurance business was given to Marsh India Insurance Brokers.

The IRDAI on January 9, 2018, disposed of the Atkins Special Risks complaint of Marsh India Insurance poaching its business by offering unlawful payment to Gupta.

Atkins hired a private investigation firm to find out any payment of kickbacks by Marsh to Gupta.

As per the SAT’s order, the investigation firm had confirmed kickbacks to Gupta for diverting the reinsurance business to Marsh India Insurance Brokers from Atkins Special Risks.

Atkins Special Risks had alleged that during the telephonic conversation, Gupta had said that Marsh India Insurance Brokers had agreed to pay him $4,00,000 in order to obtain Jagson International’s business.

The SAT, in its order, said Atkins Special Risks had relied on documentary evidence in support of the contention that Gupta had sought a bribe and was bribed by the officers of Marsh India Insurance Brokers to get Jagson International’s business.

The IRDAI stand was that Atkins did not submit any documentary proof is false, said the SAT.

An IRDAI official had then told IANS that the proof given by Atkins Special Risks was not strong and hence focused investigation on Marsh India Insurance Brokers books was not made.

Then the matter was taken to the SAT by Atkins Special Risks. Be that as it may, the right to appoint or change reinsurance broker vests with the primary insurer.

Curiously, neither the IRDAI’s order nor the SAT order mentions the name of the primary insurer for Jagson International or the reason for the change in reinsurance broker.

‘If I don’t get injured’: Zverev believes he could have beaten Nadal in French Open semis last year

0

German tennis star Alexander Zverev believes he could have defeated Rafael Nadal in last year’s French Open semifinals if he had not injured his ankle.

Last year, Nadal advanced to the final when Zverev had to retire due to an ankle injury towards the end of the second set in the semifinal. The German was leading 7-6(2) 6-6 at the time.

Then, the Spaniard went on to win the tournament, his record 14th Roland Garros title, after beating Casper Ruud in the final 6-3, 6-3, 6-0.

During an interview with Eurosport, Zverev was asked whether he thought he would have won the semifinal if he didn’t get injured, the German said: “For some reason I did. I don’t want to sound arrogant.”

“Rafa is obviously the best player to ever play on that surface so you never know what happens. You never know what happens in that match as well. If I don’t get injured, of course, I (could have lost) that match. Of course, he can go on to win his 14th Grand Slam (Roland Garros).

But I felt like I was playing the best tennis that I’ve ever played on that surface. So, for some reason, I did feel like I could at least compete with him, which I was doing. The outcome of the match obviously, always depends on little factors as well. But I did feel like that could have been the week for me,” he added.

As the clay court season begins with the Monte-Carlo Masters, Zverev will take on Alexander Bublik in the first round on Tuesday and Zverev believes he will need to be at his best.

“I have to be ready. I think against him especially you have to be ready to play at your best and you also have to be physically ready to run. You never know what you’re quite going to get. So, at the end of the day, I’m just looking forward to being back and playing and hopefully playing some good matches here,” he said.

The world no 16 has won just eight out of his 17 matches this season. The German’s best performance so far has been reaching the semifinals of the Dubai Tennis Championships.

Tiger Shroff reveals why he hates ‘competing’ with himself

Bollywood action hero Tiger Shroff has revealed why he hates competing with himself and treated his fans to some jaw-dropping pictures.

Taking to Twitter, Tiger shared a slew of pictures flaunting his perfectly chiseled body and washboard abs.

In the pictures, the son of actor Jackie Shroff can be seen sporting just blue denim, as he chose to go shirtless.

He posted the pictures with the caption: “Hate competing with myself…kicking my own a** every day.”

On the work front, Tiger will be seen in ‘Ganapath’ later this year, alongside Kriti Sanon.

The film will hit the theatres around the Dussehra festival on October 20, in five languages – Hindi, Telugu, Tamil, Malayalam, and Telugu.

The actor will also be seen in ‘Bade Miyan Chote Miyan’, which also stars Akshay Kumar. Prithviraj Sukumaran joins this spectacle as he brings on board his acting prowess as the powerful antagonist. The film will release in December 2023.

‘Samantha was our only choice for this epic’, says ‘Shaakuntalam’ director

Actress Samantha Ruth Prabhu, who swayed the nation with her moves in ‘Oo Antava’, was the only choice for ‘Shaakuntalam’, the director of the film revealed.

Director Gunasekhar kept Samantha in mind while penning the script of the historical drama.

Elaborating on the same, Gunasekhar said: “When I wanted to make the eternal love story of Shakuntala and Dushyant in an interesting backdrop of a beautiful whimsical forest much like a forest princess in a Disney kind of film, I wanted someone who could be relatable to the millennial audiences, and felt Samantha would be apt for this film and approached her.”

The filmmaker also believes that Samantha fitted the role perfectly and that no one could have essayed it better than her.

“The film traces the emotional journey of a woman who falls in love and the challenges fate throws at her. She’s a character of inner strength who depicts her emotions with dignity and grace in all that she does. Her truth is her strength, all these emotions can only be portrayed by a wonderful performer like Samantha and she was our only choice to be able to create this epic”, he added.

‘Shaakuntalam’ is set to release on April 14 in cinemas.

Dalai Lama apologises to boy, his family

0

Globally acclaimed Tibetan spiritual leader, the Dalai Lama, on Monday apologized to the boy and his family, as well as his many friends across the world, for the hurt his action may have caused.

“His Holiness often teases people he meets in an innocent and playful way, even in public and before cameras. He regrets the incident,” an official statement quoting the Dalai Lama said.

A video clip has been circulating that shows a recent meeting when the young boy asked the Dalai Lama “if he could give him a hug”.

The Dalai Lama then asked the boy to “suck his tongue” in front of a big audience and the child’s parents. The video has created a worldwide furor.

But sympathizers of the holy monks believe His Holiness shares a special bond with the young minds. For him, the children of this generation are the main protector of the world, a conveyor of peace.

“My advice or rather appeal to the children is to focus on reducing this social disparity. Whether one is a socialist or not, one must think for the greater good of humanity,” the Dalai Lama was quoted as saying while speaking virtually recently at the Fair Share for Children Summit.

The sympathizers say as per the Tibetan tradition sticking out one’s tongue is a sign of respect or agreement and was often used as a greeting in traditional Tibetan culture.

According to Tibetan folklore, a cruel ninth-century Tibetan king had a black tongue, so people stick out their tongues to show that they are not like him.

This custom has a long history. In the movie, ‘Seven Years in Tibet’, Hollywood actor Brad Pitt’s character encounters a group of Tibetans who all at once stick out their tongues at him.

The Dalai Lama comforting a young survivor during his visit to the tsunami-devastated region of Sendai in Japan in November 2011 reminds his saying, “Since a child cannot survive without the care of others, love is its most important nourishment”, remarked a close aide of the Dalai Lama while clarifying regarding misinformation spread on the social media.

He told Media that often the globetrotting holy monk is seen blessing expectant mothers by putting his hand over their baby bump.

According to a post on the website of Tibet Rights Collective, a Delhi-based advocacy and policy research group, the Dalai Lama has often pitched for incorporating ‘karuna’ or compassion as a subject in the modern education system in India, saying it should be taught to students “not as a religious subject”, but as a way to foster inner peace and learn greater human values.

Published in 2019, the children’s picture book ‘Seeds of Compassion: Lessons from the Life’ by the Dalai Lama addresses children directly and shares lessons of love and compassion, told through stories of his own childhood and talks about his mother, his first teacher of compassion.

His Holiness is of the opinion that if human beings are to be happier, education must be combined with warm-heartedness.

Another book using the childhood stories of the Dalai Lama and Archbishop Desmond Tutu was published in 2022 to show young readers how to find joy even in hard times.

Random House Children’s Books published a picture book adaptation of the international bestseller, ‘The Book of Joy’.

In ‘The Little Book of Joy’, the two spiritual masters, along with collaborators Rachel Neumann and Douglas Abrams, tell a simple story, vibrantly brought to life by New York Times bestselling illustrator Rafael Lopez, about the joy every child carries inside them — even when it sometimes hides — and how they can find it, keep it close, and grow it by sharing it with the world.

Charleston Open: Ons Jabeur stuns Bencic to clinch first title of the season

0

Last year’s runner-up, Ons Jabeur of Tunisia exacted revenge on reigning champion Belinda Bencic to capture the 2023 Charleston Open with a tight straight-sets victory over the Swiss player.

The Tunisian world No. 5 battled from a breakdown in the first set and then held her nerve in set two to move to 15-4 in her Charleston career, beating the Swiss star 7-6(6) 6-4. This was her fourth career title and the first of the season.

Interestingly, Jabeur and Bencic were the first duos to face off in back-to-back finals in tournament history.

“I’ve been wanting to win this tournament for a long time. People have been amazing to me. So it’s nice to have a great memory here in Charleston and this is a pretty good start to the clay season,” Jabeur said.

“I’m very excited to go to Paris and celebrate with my family and with my little nephew, who was just born three weeks ago. This is his gift. He doesn’t know it, but it’s his gift.”

Jabeur was just 4-4 coming into Charleston having undergone minor knee surgery in February. The No. 2 seed didn’t drop a set all week, including a win over 2017 champion Daria Kasatkina in the rain on Saturday afternoon.

With a win, Jabeur moved back up to world No. 4 as Charleston kicked off the clay swing on the WTA Tour, in which Jabeur is the defending champion in Madrid.

Since the start of the 2020 season, the Tunisian has now won 37 matches on clay, the most of any player on tour, one more than Iga Swiatek during that span.

On the other hand, all-American pair Danielle Collins and Desirae Krawczyk saved two match points to defeat top seeds Giuliana Olmos and Ena Shibahara 0-6, 6-4 [14-12] to win the women’s doubles title.

The title win is the first doubles win of Collins’ career and the eighth and first of the season for No.10 Krawczyk.

Charleston Open was the first tournament of the season for the all-American duo. In their last pairing, Collins and Krawczyk made the Wimbledon semifinals last summer.

Bomman, Bellie, Bommi & Raghu of ‘The Elephant Whisperers’ pose with the Oscar

‘The Elephant Whisperers’ director Kartiki Gonsalves posted a picture of the entire cast of the documentary including the elephants Bommi and Raghu posing with the Oscar award.

She shared the picture on Instagram and said that the cast reunited at the Mudumalai Tiger Reserve after six years.

In the photo, Kartiki held the Oscar trophy as she stood in front of Raghu and Bommi, the elephants.

Kartiki captioned the post: “Our complete family together reunited right here right now in the very space where it all began (black heart emoji) six years later @theelephantwhisperers. Image : Bomman, Bellie, Raghu and Ammu (Bommi) and the Oscar ! What a beautiful journey it’s been. April 9th, 2023.”

‘The Elephant Whisperers’ brought home the 95th Oscar for Best Documentary Short Film.

The documentary revolves around the bond between Raghu, an orphaned baby elephant, and his caretakers – a mahout couple named Bomman and Bellie – who devote their lives to protecting him from poachers and raising him.

Raghav Juyal juggled 2 projects while shooting for ‘Kisi Ka Bhai Kisi Ki Jaan’

Actor-dancer Raghav Juyal, who will be soon seen in ‘Kisi Ka Bhai Kisi Ki Jaan’, shared that he spent his time shuttling between two projects while he was shooting for the Salman Khan-starrer.

‘Kisi Ka Bhai Kisi ki Jaan’, the trailer of which will be unveiled on Monday evening, is slated for an Eid release in 2023.

Apart from working on the SKF production, Raghav was also managing his schedule for an unannounced film with Oscar Winner Guneet Monga’s Sikhya Entertainment.

Reflecting on his busy schedule, Raghav said: “I am thrilled to be part of Salman Sir’s movie, ‘Kisi Ka Bhai Kisi Ki Jaan’, which marked a great start to my 2023. In addition to this, I was also shooting for another unannounced project at the same time, which meant there was a lot of shuffling of schedules, characters, and sets.”

The actor loves to be constantly drowned in work as it gives him happiness.

He further mentioned: “However, I enjoyed every bit of it as work keeps me sane and happy. I feel lucky that I have been getting good work and opportunities to showcase my talent.”

IPL 2023: KL Rahul will aim to play a big inning but with rapid approach, says Ravi Shastri

0

Former Indian cricketer Ravi Shastri believes that Lucknow Super Giants captain KL Rahul can take chances to attack up front and convert them into big scores but with a rapid approach in the match against Royal Challengers Bangalore (RCB) on Monday.

Rahul, whose run-tally from the last four seasons is 616, 626, 670, and 593, has registered scores of 8, 20, and 35 in the Indian Premier League 2023 so far at a strike rate of 103.28.

“I think he (KL Rahul) will aim to play a big inning but with a rapid approach. With the presence of Kyle Mayers, Stoinis, and de Kock yet to come, LSG has a powerful batting line-up. So, KL Rahul can take chances,” Shastri said on ESPNcricinfo.

The former cricketer further lauded Rahul’s opening partner Kyle Mayers, who has scored 139 runs in three games, with two back-to-back half-centuries.

“I have enjoyed watching him bat. He is a destructive player and if he gets good batting conditions then he can set the game in 5-6 overs. He can create a platform for his side for a big total,” Shastri said.

He further backed fast bowler Mark Wood, who has claimed eight wickets in two matches, and said the paceman can create trouble for RCB batters in Monday’s game.

“The surface in Bangalore won’t allow spinners to come in the game. So Avesh (Khan) can play along with Mark Wood. Wood will bowl well there because it offers true bounce and his ball skids with the pace, so he will trouble the batsmen,” he said.

LSG will be looking for their third win of the season when they take the field against RCB at the M Chinnaswamy Stadium in Bengaluru on Monday.

Ayushmann added: “I’m in a much happier headspace now that I can travel and sing and do these concerts and see the smiles on people’s faces! I can’t wait for my U.S. tour. Amit Shah likely to be in Bengal this weekend

Union Home Minister Amit Shah is likely to make a visit to West Bengal this weekend in the wake of the forthcoming three-tier panchayat elections in the state, BJP sources said.

A member of the state committee of BJP said that the Minister is likely to arrive in Kolkata on Friday morning after which he is expected to attend a rally in Birbhum.

“In the afternoon, he is scheduled to return to Kolkata and later in the evening, Shah is expected to have a meeting with the state BJP core committee members. The next day he is scheduled to offer prayers at the Dakshineswar Kali Temple and will return to Delhi later,” the member said.

He added that in the recent past, a number of the scheduled trips of the Union Home Minister had been canceled at the last moment.

“But we are hopeful that he will visit this time finally. He is expected to give directions to the state party leaders of the strategy in view of the panchayat polls this year as well as the 2024 Lok Sabha elections,” the state committee member said.

Political observers feel that the choice of Birbhum as the proposed venue for the rally is quite interesting.

It comes in the absence of the Trinamool Congress’s district president Anubrata Mondal, who is currently lodged at the Tihar Jail for his alleged involvement in the multi-crore cattle smuggling scam in West Bengal.

Against the backdrop of the development, the saffron camp has decided to focus on this district, the observers noted.

Leader of the Opposition in the state Assembly, Suvendu Adhikari has already expressed confidence in the BJP winning both the Lok Sabha constituencies in Birbhum next year.
