Sunni Board offers to surrender claim in Ayodhya case, has 3 conditions

Hours before the Supreme Court concluded the 40-day hearing on the Ram Janmabhoomi-Babri Masjid title suit, the Ayodhya mediation panel submitted its final report to the five-judge bench.

Outlining what has been described as a settlement agreement, people familiar with the development said on Wednesday.

A key element of this proposed settlement is an offer by the UP Sunni Waqf Board to surrender its claim on the disputed site.

The offer is conditional on the government accepting three conditions to protect the interests of Muslims in other parts of the country including Ayodhya.

It is not clear how, if at all, this last-minute offer would impact the proceedings before the court.

Outlining its three conditions, the Waqf Board wants the UP government to rebuild 22 mosques lying in dilapidated condition, strict implementation of the Places of Religious Worship Act 1991.

Allowing Muslims to pray in all mosques under the central government’s Archaeological Survey of India.

The Constitution bench led by Chief Justice of India Ranjan Gogoi completed the oral hearing later on Wednesday and reserved its judgment. The parties concerned do still have three days to file written notes.

The bench has to determine cross-appeals upon the Allahabad high court’s 2010 judgment that the 2.77-acre disputed land in Ayodhya be divided evenly amongst the three parties the Sunni Waqf Board, the Akhara and “Ram Lalla Virajman”.

MR Shamshad, who represented one of the litigants Iqbal Ansari in the Supreme Court, insisted the Sunni Board’s offer to surrender its right over the land would not make a difference.

“This case is contested by six other Muslim parties in which Sunni Board is one party, and it has no more locus than any other individual Muslim parties,” Shamshad said.

The top court had earlier this year explored the possibility of mediation for an amicable settlement to the dispute, but the arbiters made little headway.

A three-member mediation panel led by retired judge justice FM Ibrahim Kalifulla and comprising Art of Living founder Ravi Shankar and senior advocate Sriram Panchu tried to work for a resolution but failed to bridge differences.

The Constitution bench has subsequently held daily hearings starting on August 6.

Last month, the top court, at the request of the mediation panel, allowed them to simultaneously talk to the parties concerned but many parties, particularly those known to have adopted a hard-line, stayed away from the final round of negotiations.

Housed in PwC’s newly constructed 60,000 sq ft sprawling facility in the city, these labs will be used to incubate new solutions to address issues that are impacting businesses globally like Industry 4.0.

Bajaj Auto Ltd, India’s second largest motorcycle manufacturer, on Wednesday announced its second innings in the scooter segment, almost after a decade’s gap, with the launch of its electric scooter — Chetak. The Pune-based company did not reveal the price of the product and will announce it before beginning dispatches.

Bajaj stopped manufacturing traditional scooters around 2009 in order to focus on motorcycles.

The new Chetak will be available in two variants and offer a range of 85 kilometre and 95 kilometre.

According to Rajiv Bajaj, managing director Bajaj Auto, there is immense potential for scooters and three-wheelers in the electric space.

“When we do something it’s better to come first and there is virtually no point coming second or third. It’s very important to be first to market. Scooters and step-through are a very important segment and we have not made the electric Chetak to be in the volume space. We are trying build meaningful niches with three wheelers, super bikes and electric scooters,” said Bajaj.

The company will start selling the electric scooter in January in Pune and later expand to Bangalore. Subsequent expansion will depend on the demand in these two cities. The vehicle will be sold from the Pro Biking dealerships of the company from which it also sells the KTM super bike.

“Biggest hurdle (for adoption of electric mobility) is the conflicting idea in minds of manufacturers since they are making money from petrol and diesel vehicles. The fact that Bajaj doesn’t sell scooters is our bigger strength. We are starting from here because there is not conflict of interest. When you enter into a new market you don’t make money from day one. The price will not be viable from day one,” added Bajaj.

The reduction in corporate tax will give the company an additional room of ₹450-500 crore, which it will use to absorb some of the cost of developing and manufacturing the electric scooter.

On the last day of daily hearings in the Supreme Court on the Ayodhya temple-mosque case, there were dramatic moments as a senior lawyer tore up a map and relentless interruptions infuriated the judges.

Rajeev Dhavan, representing Muslim petitioners including the Sunni Waqf Board in the title suit, tore up a pictorial map showing the Ram Janmasthan. “Can I have your permission to tear it,” Mr Dhavan said to the judges.

He acted after Vikas Singh, the lawyer for the All India Hindu Mahasabha, tried to place a publication by Kunal Kishore as evidence during his arguments claiming ownership of the disputed land in the temple town in Uttar Pradesh.

“The Supreme Court should not rely on this book,” Mr Dhavan said, requesting permission to tear it up.

After the pages were torn, interruptions from both sides and the commotion angered the judges.

“Decorum has been spoiled, decorum is not maintained. If proceedings continue in this manner, we would just get up and walk out,” said the Chief Justice.

Later, Mr Dhavan complained to the top judge that the “news that I am tearing papers is going viral”.

“I wanted to throw it away. The Chief Justice said I can tear it,” he pointed out.

“The news of tearing is going viral. We have seen it,” Justice SA Nazeer said.

In another notable exchange, Mr Dhavan described the argument of PN Mishra, the lawyer for the Hindi petitioners, as “foolish”.

“Mr Mishra’s argument is next to foolish. Please sit down. He doesn’t know. It is not personal,” Mr Dhavan said.

PN Mishra, protesting the descriptor, said: “I have written a book on land law and got a PhD…” To which, Mr Dhavan shot back: “I can salam (salute) his book.”

Justice Gogoi said the lawyer could put out a clarification that it was the Chief Justice who had allowed him to tear the paper.

Daily hearings in the politically sensitive case will end at 5 pm, the Chief Justice said as the proceedings began this morning. “We will rise by 5 pm,” Chief Justice Gogoi said after a lawyer asked the Supreme Court for more time for arguments.

The court is expected to announce a verdict in the 134-year-old Ram Janmabhoomi-Babri Masjid title suit before the Chief Justice leaves office on November 17.

Many Hindus believe the land was the birthplace of Lord Ram and a mosque was built there on the ruins of an ancient temple. The 16th-century Babri mosque was razed in December 1992 by right-wing activists, a cataclysmic event that sparked riots across the country and changed Indian politics forever.

Several mediation attempts have failed to solve the decades-old dispute.

India can’t sacrifice economic strength to comply with US sanctions: Sitharaman

India wants to comply with global sanctions, including US sanctions on Venezuela and Russia, but also needs to maintain its strength and strategic interests, Finance Minister Nirmala Sitharaman said in an interview on Tuesday.

The US in January forced the most robust penalties yet on Venezuela’s oil production. The move has scared away some global customers, but with few alternative suppliers of heavy oil, Indian refiner Reliance Industries Ltd has been buying Venezuelan crude from Russian major Rosneft.

The company is set to resume direct oil loadings in the South American nation after a four-month pause.

Sitharaman said the Indian government has expressed its view to the United States.

“In particular points which are important for India’s imperative interests, we have demonstrated to the United States that India is a strategic partner for the USA and you want a strategic associate to be reliable and not impaired,” she said.

“We value the strong partnership with the United States Of America, but we should equally be allowed to be a strong economy.”

The International Monetary Fund earlier on Tuesday lowered its outlook for Indian growth in 2019, citing weaker-than-expected domestic demand. The US-China trade conflict will cut 2019 global increase to its most moderate pace since the 2008/09 economic crisis, the IMF said.

India’s gross domestic product grew at its weakest pace since 2013 between April and June, stoking expectations of further stimulus.

“Global headwinds … are getting stronger by the day,” Sitharaman said. Asked about further fiscal stimulus, she said: “I have not closed the door” on that.

New Delhi has been trying to boost domestic growth through an infrastructure package and a new loan program organized with the banking sector that has doled out loans worth over 80,000 crore (8.7 billion pounds), she said.

Have you walked into a theatre in Hyderabad on time for a movie, only to find advertisements playing for several minutes, delaying the time that the movie screening begins? Well, in Hyderabad, it may be against the law.

An FIR was filed against the Cinepolis in Kukatpally after a complaint by a citizen, who argued that delaying the screening of the film is an ‘unfair trade practice’ under the Telangana State Cinema Regulations Act, 1955.

“Committing to a time to the patrons, and making them watch advertisements to generate higher revenue during the time when the show is supposed to start, is highly unethical of the multiplex management and disrespecting of the time of the patrons. This is pure deficiency of service and affects the plans made for the patrons,” Sai Teja from the Forum Against Corruption (FAC) wrote in his complaint to the KPHB police.

Sai Teja said that he had visited the theatre on October 8, for a movie that was supposed to start at 4:30 pm, and filed a police complaint on October 9. An FIR was filed on October 14.

“I spoke to the management and they said that they were playing the advertisements for generating revenue. It was after this, that I approached the police” Sai Teja, who is Head of Public Relations & Social Media for the FAC, told TNM.

A case has now been registered with the KPHB police under relevant sections of the Telangana State Cinemas Regulation Act 1955 and the management of Cinepolis India Private Ltd and the operations manager of the mall have now been named as accused in the case.

“Every theatre has to maintain a complaint book on their premises that we can ask for. One needs to write a complaint in the book and take a photograph so that we can prove that we have already raised the issue when we approach the police,” Sai Teja says.

“After this, they can approach the local police station or file a complaint on the police’s ‘Hawk-Eye’ mobile application, following which the police will begin an investigation,” he adds.

PMC Bank crisis: 2 account holders die of heart attack, 1 commits suicide

With the Reserve Bank of India (RBI) placing withdrawal restrictions in Punjab and Maharashtra Co-operative (PMC) Bank following a 4,355 crore scam, at least three stressed account holders have so far died in Mumbai, according to agency reports.

Two of the deceased PMC account holders were said to be distressed following the crisis and died of heart attack while the third one committed suicide.

Less than 24 hours after 51-year-old Sanjay Gulati died of cardiac arrest after returning from a protest in the PMC Bank issue, another PMC Bank customer Fattomal Punjabi also died due to heart attack, ANI reported.

Punjabi’s family alleged that he was under stress following the crisis in PMC Bank.
In the third case, Dr Nivedita Bijlani (39) allegedly ended her life by taking an overdose of sleeping pills at her residence in suburban Versova late Monday evening, PTI reported.

She is said to have deposits of over ₹1 crore with PMC Bank. The police, however, have denied any link to the PMC Bank issue with her suicide.

Gulati, who had recently lost his job with collapsed airline Jet Airways, had kept his lifelong savings of ₹90 lakh in the bank. He was in regular need of cash to pay for medical bills of his specially-abled son.

Last month, the RBI restricted the activities of the PMC Bank for six months and asked it to not grant or renew any loans and advances, make any investment or contract any debt, including financing of funds and permission of fresh deposits.

The RBI has now increased withdrawal limits to ₹40,000, saying it will give relief to 77% of depositors.

PMC Bank is a multi-state scheduled urban cooperative bank with operations in Maharashtra, New Delhi, Karnataka, Goa, Gujarat, Andhra Pradesh, and Madhya Pradesh. With a system of 137 branches, it stands among the top 10 cooperative banks in the nation.
