Jammu and Kashmir governor Satya Pal Malik on Tuesday put leaders of the Hurriyat, mainstream parties and religious preachers in Jammu and Kashmir in his line of fire for using their influence to get the children of ordinary Kashmiris killed while none of them lost their own to terrorism.

“Whoever he is – a Hurriyat leader, a Maulvi, or a mainstream political leader, none of them have lost their children to terrorism. All their children are studying abroad and are well settled. They have only misled the children of the common people to get them killed in the name of Allah and Jannat,” he said at the convocation of Shri Mata Vaishno Devi University in Katra near Jammu.

“These leaders, politicians, bureaucrats, affluent and powerful shattered so many dreams and ruined the lives of several youths. These social, religious leaders, clerics, Hurriyat or mainstream leaders over the years have incited children of common people to get them killed but neither a single child of theirs has died nor have joined militancy. But the children of common people were incited in the name of Allah and Jannat. Aam Admi ko Jannat ka rasta dikhaiye aur marwa dijiye, ye hota raha hai. (The children of commoners are shown way to paradise to get them killed.) This is what has been going on in Kashmir for the past so many years,” he asserted.

Malik urged the civil society and the youth of Kashmir to understand the nefarious designs of such people.

“The most beautiful part of the world is with you. Be masters of your destiny. Delhi won’t take it away. In fact, Delhi has opened its coffers for Jammu and Kashmir. So, be part of development and tread the path of progress,” he said.

Malik also took a jibe at successive governments in the state saying, “Had the funds sent by the Centre over the years been used properly, the roofs of the houses in the state would have been of gold.”

The governor said that last year he had sanctioned 53 degrees colleges and 50 more were being opened.

On August 5, Centre abrogated Article 370 which had guaranteed special status to Jammu and Kashmir. In another significant move, the Centre bifurcated the state into two union territories — Jammu and Kashmir and Ladakh.

On October 31, the two UTs will officially come to existence.

Clearing the decks for the opening of the Kartarpur Sahib corridor, India and Pakistan will sign the final agreement on October 24 at the ‘zero-point’ on the border near the Dera Baba Nanak. The choice of the spot to finally sign the agreement means that officials won’t have to cross over and also hints that both sides aren’t keen on holding a proper ceremony for it.

The signing of the pact, after protracted negotiations during which Pakistan refused to drop a $20 fee, will allow Indian pilgrims to take the cross-border corridor to Darbar Sahib gurdwara in Kartarpur, where Guru Nanak spent the final years of his life. Both countries are expected to hold events on November 9 to mark the opening of their sections of the corridor, but there would not be any joint event, sources have said.

The Indian government had on Monday said it would sign an agreement with Pakistan to open the cross-border corridor to Darbar Sahib gurdwara in Kartarpur before November 12 despite Islamabad not ceding to the request of withdrawing the service fee of $20 on pilgrims.

“While agreeing to sign the contract, the Government of Pakistan has been once again forced to revise its demand to levy service fee of $20 on pilgrims. India would be able to modify the Agreement respectively at any time,” the MEA had stated.

From the very start, Pakistan has been insisting on levying a fee of $20 each pilgrim visiting Kartarpur Sahib gurdwara through the corridor. However, the Indian side has urged Islamabad to not charge the proposed fee.

Earlier in the day, Dawn had quoted Pakistan foreign office spokesperson Mohammed Faisal saying that the issue of service charge has been resolved. The passageway will expedite visa-free migration of Indian pilgrims, who will have to just obtain a permit to visit Kartarpur Sahib, which was founded in 1522 by Sikh faith founder Guru Nanak Dev.

The online registration of pilgrims has been delayed due to the delay in the signing of the agreement. It will only start after the agreement is signed. Pakistan will take six days to process the request and four days before the date of travel, the Pakistani authorities will give the names cleared to travel.

A large number of commuters in Hyderabad on Monday took to the Metro as the ongoing strike by employees of the Telangana State Road Transport Corporation (TSRTC) intensified.

With Telangana Congress leaders and workers attempting to lay siege to Chief Minister K. Chandrasekhar Rao’s residence in support of the strike, the police took a bizarre decision, to shut down the Begumpet station for public use briefly, further inconveniencing office goers.

Begumpet is a key area in the heart of Hyderabad, and the metro station receives one of the highest footfalls after interchange stations. Schools re-opening after Dasara holidays on Monday only added to the woes of the public.

This resulted in massive traffic snarls across the city, especially stalling those who were travelling from Secunderabad to Hyderabad.

Meanwhile, Hyderabad Metro Rail Limited (HMRL) Managing Director N V S Reddy said that the footfall of the metro crossed four lakh on Monday, which was a new record.

Noticing a heavy rush of commuters right from the morning, the HMRL said that they extended the peak hours and ran trains with a frequency of 3.5 and 4.5 minutes, and with a 6 and 7-minute frequency during the rest of the day.

The HMRL MD said that four extra trains and 120 extra trips were carried out, which took the total number of trips to 830, against the 710 trips that the metro was carrying out, before the TSRTC strike began.

Meanwhile, hundreds of policemen were deployed around Pragati Bhavan, the Chief Minister’s official residence, to stop protesters. Police officials also searched hotels and lodges in Begumpet and surrounding areas to check if Congress workers were staying there.

The Congress party had called for a “Chalo Pragati Bhavan” to protest the government’s adamant attitude over the demands of TSRTC employees, whose strike entered the 17th day on Monday.

The Chief Minister has ruled out talks with the employees and declared that over 48,000 dismissed themselves by not joining duties.

“Support India’s Objectives, But Concerned About Kashmir Situation”: US

The US on Tuesday said while it supports India’s development agenda behind scrapping special status to Jammu and Kashmir under Article 370 of the Constitution, it was concerned over the current situation in the Valley.

It said it was closely monitoring the situation in Jammu and Kashmir following India’s decision to scrap special status and divide the state into two Union Territories on August 5.

The Indian government has argued that its decision on Article 370 was driven by a desire to increase economic development, reduce corruption and uniformly apply all national laws in Jammu and Kashmir, particularly in regard to women and minorities, Acting Assistant Secretary of State for South and Central Asia Alice G Wells told Subcommittee on Asia, the Pacific, and Nonproliferation of the US House Foreign Affairs Committee.

“While we support these objectives, the US State Department remains concerned about the situation in the Kashmir Valley, where daily life for the nearly eight million residents has been severely impacted since August 5,” Ms Wells said in a statement submitted to the Congressional subcommittee a day before the hearing on “Human Rights in South Asia: Views from the State Department and the Region”.

The US State Department, she said, has closely monitored the situation in Jammu and Kashmir following India’s decision on August 5.

“While conditions in Jammu and Ladakh have improved, the Valley has not returned to normal,” Ms Wells said, adding the State Department has raised concerns with the Indian government regarding detentions of residents and political leaders, including three former chief ministers of Jammu and Kashmir.

“We have urged Indian authorities to respect human rights and restore full access to services, including internet and mobile networks,” she said.

Postpaid mobile service has been restored in the Valley, but internet access remains intermittent, Ms Wells said.

She said both foreign and local journalists have extensively covered developments in Jammu and Kashmir, but many have faced challenges in access and reporting due to security restrictions.

“While exact figures are difficult to ascertain, we understand several thousand people have been detained over the past two months, although many have subsequently been released,” the top US diplomat said.

According to government sources, hundreds remain in detention – many without charges – under the Public Safety Act, which allows for administrative detention of up to two years, Ms Wells said.

Welcoming actions by India to improve the situation and address local grievances, she said the Home Ministry recently said statehood will eventually be restored to Jammu and Kashmir, reaffirming what Prime Minister Narendra Modi announced in his Independence Day speech on August 15.

The US, she said, also encourages the Indian government to follow through on its commitment to hold assembly elections in the state at the earliest opportunity. Some local political leaders were released earlier this month, a trend Ms Wells said she hopes will continue.

Government offices, primary schools, and colleges are open, although student attendance remains low, she said.

The Indian Supreme Court, Ms Wells said, is planning to hear petitions related to Kashmir on November 14 and the Jammu and Kashmir High Court is reviewing cases.

“While these steps are positive, they are incremental, and we continue to press India to restore everyday services, including SMS and internet communications, as swiftly as possible,” she said.

India To Sign Kartarpur Pact Wednesday, Urges Pak To Reconsider $20 Fee

India is ready to sign an agreement with Pakistan on Wednesday for allowing Sikh pilgrims to visit the Kartarpur Sahib Gurdwara in the neighboring country through a much-awaited corridor set to open next month, the Ministry of External Affairs said today. It expressed “disappointment” at Pakistan’s decision to charge a $20 fee, but said that India will go ahead with the agreement for now.

Differences over the fee had resulted in a delay in launching online registration for the first pilgrimage to the Sikh religious site on November 9. The imposition of the $20 fee on every pilgrim, translating to approximately Rs. 1,400 in Indian currency, will help Pakistan rake in over Rs. 21 crore every month.

Last month, India and Pakistan agreed on visa-free travel of Indian pilgrims to the Gurdwara Darbar Sahib through the four-kilometer Kartarpur border corridor. Through this, pilgrims will only have to carry their passports to visit the holy site located in the neighboring country.

The two nations also decided that 5,000 pilgrims can visit the shrine every day, and additional pilgrims will be allowed on special occasions, subject to the expansion of facilities on the Pakistani side.

The $20 fee had caused some heartburn in India, with both Punjab Chief Minister Amarinder Singh and Union Minister Harsimrat Kaur Badal demanding its withdrawal.

In a video shared on social media, Harsimrat Badal stated it was “highly shameful” for Imran Khan to think that the service fee will raise his country’s economy. “How will a poor devotee pay this amount? Pakistan has made a trade out of faith. Imran Khan’s announcement that this fee will increase the economy is highly shameful,” she was heard saying in the clip.

Amarinder Singh claimed that imposing such a fee will prevent less fortunate pilgrims from realizing their long-cherished dream of visiting the final resting place of Sikh guru Guru Nanak. “Let these people not be deprived of this once-in-a-lifetime opportunity of ‘khulle darshan’ of the historic Gurdwara,” he tweeted.

On Sunday, Pakistan Prime Minister Imran Khan had ruled out the possibility of any delay in the opening of the Kartarpur corridor. “Pakistan is all set to open its doors for Sikhs from across the globe as the construction work on the Kartarpur project enters its final stages. It will be opened to the public on November 9, 2019,” Mr Khan said in a Facebook post, indicating that it will be ready in time for the 550th birth anniversary of Guru Nanak.

His government, however, refused to budge on the matter of the $20 fee.

In the 2014 elections, BJP had won 47 seats and formed the government on its strength while the Congress managed just 15 seats. The INLD finished second with 19 seats.

Chidambaram Charged In INX Case; He’s Lost 4 kg In Jail, Says Lawyer

Former Finance Minister P Chidambaram, his son Karti and senior government officials have been charged in the INX Media corruption case for causing huge losses to the taxpayer in return of kickbacks, the Central Bureau of Investigation told the Supreme Court on Friday.

Rejecting Mr Chidambaram’s application for bail, the CBI informed the court that the 74-year-old Congress leader acts as a flight risk and could also affect a witness. The charge sheet was filed before a special court, the agency said.

“The witness has stated that he is being influenced. We don’t wish to disclose his identity and his name has been given submitted to the CBI court in a sealed cover,” Solicitor General Tushar Mehta, representing the CBI, said.

Stating that the nation needs to have a “zero-tolerance strategy” on corruption, Mr Mehta said the court that charges in the case upon Mr Chidambaram include forgery.

Countering the CBI, Mr Chidambaram’s lawyer and party colleague Kapil Sibal said, “P Chidambaram’s passport is impounded, there is a lookout notice against him and he has never applied for travel. So where is the question of flight risk? How can he run away? He is recognized all over the world.”

Mr Chidambaram has lost weight while in custody – more than 4 kg – and given the onset of winter and fear of dengue, there is no justification to keep him in jail, Mr Sibal said. “It is only to humiliate him. If the witness is influenced, the government has to protect the witness… he hasn’t influenced anyone,” the Congress leader added.

After hearing both sides, the Supreme Court reserved its order on Mr Chidambaram’s bail plea.

P Chidambaram, who served twice as a finance minister and also as a home minister in the previous Congress-led governments, was arrested in a dramatic late-night swoop on August 21 by officers from the CBI.

After being questioned at the agency’s headquarters for 14 days, he was transferred to the capital’s Tihar jail under judicial custody on September 5.

On Wednesday, he was arrested by the Enforcement Directorate which is investigating a separate money laundering case. He was moved to the agency’s custody yesterday out of Tihar.

Mr Chidambaram is facing claims he received bribes in exchange for foreign investment clearances to a media company INX Media. The company’s co-founders Peter and Indrani Mukerjea are currently in prison in the trial including the murder of Indrani’s daughter Sheena Bora. Indrani Mukerjea has become an approver in the case versus the Chidambaram’s and the investigative agencies have based their case on her testimony.

Mr Chidambaram’s son Karti and several government officials are also being investigated over their role in the scandals. The Chidambarams have denied any wrongdoing and said the charges are politically motivated.

On a complaint received by Raj Bhavan recently, the governor held a meeting with the officials of RUSA and reviewed progress in the scheme. The official informed that the RUSA funds received by seven universities in Telangana State were likely to be lapsed due to non-release of matching grant from the State government.

The seven universities which got the funds are JUTU (Hyderabad), Osmania University (Hyderabad), Potti Sreeramulu Telugu University, Kakatiya University (Warangal), Telangana University (Nizamabad), Mahatma Gandhi University (Nalgonda) and Palamur University (Mahbubnagar). She directed the Vice-Chancellors’ of seven universities, that are selected to get funds under the central scheme, to take appropriate steps immediately and utilize RUSA funds without any lapse by March 2020. The Governor also directed the university heads to take necessary steps to fill all the vacant faculty positions and to get matching grants from the State government as stipulated under RUSA norms.

Former Union Minister P Chidambaram left Delhi’s Tihar jail today, more than a month after he was taken there, as a court sent the 74-year-old Congress leader to the custody of the Enforcement Directorate in the INX Media money laundering case till October 24.

Allowing the probe agency to question Mr Chidambaram in custody, the court also permitted him to have home-cooked food, a separate cell, a western toilet, spectacles, and medicines. The Enforcement Directorate opposed his request for air-conditioning. Mr Chidambaram will be allowed to meet family members and relatives for half-an-hour every day.

“We will take care of his security. Home food, western toilet and family visits will be taken care of,” the agency told the court.

The court directed the Enforcement Directorate to get him medically examined every 48 hours.

Arrested by the CBI on August 21, Mr Chidambaram had been in judicial custody at the Tihar jail since September 5 in the INX Media corruption case filed by the CBI. He was arrested by the Enforcement Directorate yesterday.

The Enforcement Directorate wants to question him in a case that allegedly involves money-laundering. It had requested 14-day custody of the Congress veteran.

He was taken to the agency’s office in Delhi in the evening for questioning and will be kept at either the Tughlaq Road or Tilak Marg police stations. He will be brought back to the Enforcement Directorate’s office around 10:30 am tomorrow.

Mr. Chidambarm’s son Karti said, “It’s a blatant misuse of law. When the 60-day mandatory period is ending, the ED has arrested him. I am an MP and so is my Father. All our properties and assets are in the public domain. This is not a genuine investigation, it’s a ploy to prolong his custody.”

Mr Chidambaram and his son have denied any wrongdoing and have said they are being targeted by the ruling BJP to settle political scores.

Sunni Board offers to surrender claim in Ayodhya case, has 3 conditions

Hours before the Supreme Court concluded the 40-day hearing on the Ram Janmabhoomi-Babri Masjid title suit, the Ayodhya mediation panel submitted its final report to the five-judge bench.

Outlining what has been described as a settlement agreement, people familiar with the development said on Wednesday.

A key element of this proposed settlement is an offer by the UP Sunni Waqf Board to surrender its claim on the disputed site.

The offer is conditional on the government accepting three conditions to protect the interests of Muslims in other parts of the country including Ayodhya.

It is not clear how, if at all, this last-minute offer would impact the proceedings before the court.

Outlining its three conditions, the Waqf Board wants the UP government to rebuild 22 mosques lying in dilapidated condition, strict implementation of the Places of Religious Worship Act 1991.

The Constitution bench led by Chief Justice of India Ranjan Gogoi completed the oral hearing later on Wednesday and reserved its judgment. The parties concerned do still have three days to file written notes.

The bench has to determine cross-appeals upon the Allahabad high court’s 2010 judgment that the 2.77-acre disputed land in Ayodhya be divided evenly amongst the three parties the Sunni Waqf Board, the Akhara and “Ram Lalla Virajman”.

MR Shamshad, who represented one of the litigants Iqbal Ansari in the Supreme Court, insisted the Sunni Board’s offer to surrender its right over the land would not make a difference.

“This case is contested by six other Muslim parties in which Sunni Board is one party, and it has no more locus than any other individual Muslim parties,” Shamshad said.

The top court had earlier this year explored the possibility of mediation for an amicable settlement to the dispute, but the arbiters made little headway.

A three-member mediation panel led by retired judge justice FM Ibrahim Kalifulla and comprising Art of Living founder Ravi Shankar and senior advocate Sriram Panchu tried to work for a resolution but failed to bridge differences.

The Constitution bench has subsequently held daily hearings starting on August 6.

Last month, the top court, at the request of the mediation panel, allowed them to simultaneously talk to the parties concerned but many parties, particularly those known to have adopted a hard-line, stayed away from the final round of negotiations.

On the last day of daily hearings in the Supreme Court on the Ayodhya temple-mosque case, there were dramatic moments as a senior lawyer tore up a map and relentless interruptions infuriated the judges.

Rajeev Dhavan, representing Muslim petitioners including the Sunni Waqf Board in the title suit, tore up a pictorial map showing the Ram Janmasthan. “Can I have your permission to tear it,” Mr Dhavan said to the judges.

He acted after Vikas Singh, the lawyer for the All India Hindu Mahasabha, tried to place a publication by Kunal Kishore as evidence during his arguments claiming ownership of the disputed land in the temple town in Uttar Pradesh.

“The Supreme Court should not rely on this book,” Mr Dhavan said, requesting permission to tear it up.

After the pages were torn, interruptions from both sides and the commotion angered the judges.

“Decorum has been spoiled, decorum is not maintained. If proceedings continue in this manner, we would just get up and walk out,” said the Chief Justice.

Later, Mr Dhavan complained to the top judge that the “news that I am tearing papers is going viral”.

“I wanted to throw it away. The Chief Justice said I can tear it,” he pointed out.

“The news of tearing is going viral. We have seen it,” Justice SA Nazeer said.

In another notable exchange, Mr Dhavan described the argument of PN Mishra, the lawyer for the Hindi petitioners, as “foolish”.

“Mr Mishra’s argument is next to foolish. Please sit down. He doesn’t know. It is not personal,” Mr Dhavan said.

PN Mishra, protesting the descriptor, said: “I have written a book on land law and got a PhD…” To which, Mr Dhavan shot back: “I can salam (salute) his book.”

Justice Gogoi said the lawyer could put out a clarification that it was the Chief Justice who had allowed him to tear the paper.

Daily hearings in the politically sensitive case will end at 5 pm, the Chief Justice said as the proceedings began this morning. “We will rise by 5 pm,” Chief Justice Gogoi said after a lawyer asked the Supreme Court for more time for arguments.

The court is expected to announce a verdict in the 134-year-old Ram Janmabhoomi-Babri Masjid title suit before the Chief Justice leaves office on November 17.

Many Hindus believe the land was the birthplace of Lord Ram and a mosque was built there on the ruins of an ancient temple. The 16th-century Babri mosque was razed in December 1992 by right-wing activists, a cataclysmic event that sparked riots across the country and changed Indian politics forever.

Several mediation attempts have failed to solve the decades-old dispute.
